Incident 11-14th February 2010

Hospital investigation including Root Cause Analysis (RCA) not disclosed until recently following Subject Access Request. Documented in Empey report as "not available".

  • DS continues to practise at Clementine Churchill Hospital (CCH).

  • DS interviewed by Dr Roddis from "Healthcare Performance Ltd", a company commissioned to investigate the case and previous patients of DS.

DS suspended from CCH.  NHS Hospital aware of incident but allows DS to continue work.

15th October 2010 - GMC Fitness to Practise Hearing

No case to answer.

18th October 2010 - Inquest Commences

DS evidence brought forward from day three to day one.  Inquest adjourned during DS evidence.  Coroner Andrew Walker suspects criminal negligence manslaughter.  Case referred to CPS.

November 2010 - GMC involvement

Mr Drury, General Surgeon, expert witness for GMC gives report to GMC.  He did not have access to medical notes to write this report.  The Empey report was his point of reference.  Restrictions now in place for DS to practise, no emergency surgery and supervision.

Medical Director at NHS Hospital remains happy to allow DS to continue work.

Police interviews.

Charged July 2012 with Manslaughter and Perjury

NHS post - on indefinite leave.  No pay.

GMC - temporary suspension from the register pending outcome of trial.

10th July 2012 - Suspension from NHS post and salary stopped
19th July 2012 - Suspended from GMC register pending result of trial
2nd October 2013 - Trial started at Old Bailey - lasting 5 and a half weeks
5th November 2013 - Found not guilty of perjury but guilty of manslaughter and sentenced to 2 and a half years imprisonment.  Taken to HMP Belmarsh.
4th February 2015 - Released from prison and sent home on license.
December 2015 - Granted leave to appeal conviction by three judges headed by Lady Justice Heather Hallett.
